Commission rules in Queensland
In Queensland, you appoint a sales agent using a Form 6 (Residential agent appointment or reappointment).
The Form 6 sets out how much commission the agent will charge and any other costs they could incur on your behalf, such as advertising. It must disclose the advertising and marketing expenses the agent is authorised to incur, and any rebates or discounts the agent may receive on them.
The Real Estate Institute of Queensland advises agents to state commission inclusive of GST, for example "3.3% (inclu GST)" rather than "3% + GST".
No law sets a commission rate in Queensland. The amount is agreed between you and the agent on the Form 6.
