AgentLink Pty Ltd ACN 682 149 211 ("AgentLink", "we", "us", "our") helps make selling, renting, and buying property simpler. Our goal is to streamline the process while keeping everyone informed at every stage. These terms explain important details about our services and how you can use them. Please read them carefully before proceeding. If you have any questions, contact us at info@agentlink.au.

How these Terms are organised

Part A — General Terms apply to everyone who accesses or uses our website.

Part B — Terms for Homeowners and Enquirers apply if you submit a property enquiry or request that we introduce you to an agent.

Part C — Terms for Agents apply if you are a real estate agent who holds an AgentLink account, whether as a Featured, Featured+, or Registered agent.

By using, registering on, or interacting with the website, or by submitting an enquiry or accepting a lead, you agree to the parts of these Terms that apply to you.

PART A — GENERAL TERMS

1. About these Terms

1.1 These terms ("Terms") apply to your use of this website, including any mobile platforms or applications (collectively, the "website"), whether operated by us or through third-party services.

1.2 By using, registering on, or interacting with the website, you agree to these Terms. If you do not accept them, you must stop using the website.

1.3 Real estate professionals are also subject to the additional terms in Part C, and may be subject to further terms for specific services.

1.4 These Terms are the latest version and replace all previous versions.

2. Acceptance and application

2.1 Different parts of these Terms apply to different users, as set out above. Where a part applies to you, your use of the relevant service constitutes acceptance of that part.

2.2 Your use of the website is governed by the laws of New South Wales, Australia (see clause 10).

3. About AgentLink and our role

3.1 AgentLink helps Australians simplify the process of buying, selling, and leasing residential or commercial real estate by providing research services to those genuinely looking to buy, sell, or rent property. Our role is to help you identify and connect with real estate agents we believe have the skills and experience to handle your transaction.

3.2 When you submit your details on our website, we research local agents based on your information and introduce you to those we consider a good fit. Our recommendations reflect our opinions, and we do not take responsibility for your final choice of agent or the outcome of your property transaction.

3.3 AgentLink earns a fee from agents once a property is successfully sold, leased, or purchased through a buyer's agent. Where a homeowner is introduced to an agent, this fee is paid by the agent, not by the homeowner.

3.4 Our vendor research service is completely free for property owners. Featured and Featured+ agents may pay AgentLink a subscription fee or retainer to appear on our website. To be featured, they must meet the minimum criteria set by AgentLink.

3.5 Neither AgentLink nor any third-party data provider makes any representation or warranty regarding the accuracy, currency, completeness, suitability, or reliability of data accessible via any third-party API product used in providing our services.

4. Intellectual property

4.1 All intellectual property on this website, including content, materials, and services, belongs to AgentLink or is licensed for our use. Nothing in these Terms grants you ownership or rights over our intellectual property or that of our third-party licensors.

4.2 You are permitted to access and use this website for personal or business purposes related to our services, under a limited, non-exclusive, revocable licence.

4.3 You may not copy, reproduce, distribute, or use any content, trademarks, or intellectual property belonging to AgentLink or its licensors without prior written approval.

5. Disclaimer and limitation of liability

5.1 This website, including its content and services, is provided "as is" and "as available." We do not guarantee its accuracy, reliability, completeness, or security. You use the website at your own risk.

5.2 We accept no liability for any form of loss or damage — whether direct, indirect, incidental, or consequential — including personal injury, financial loss, data loss, or reputational harm.

5.3 AgentLink is not liable for any disputes, misrepresentations, or issues arising between agents and homeowners, or between any other users of the platform. You assume full responsibility for your dealings with other users.

5.4 Your use of the website means you indemnify AgentLink, its affiliates, employees, and providers against any claims or losses arising from your actions or reliance on website content.

5.5 Where liability cannot be excluded under the Australian Consumer Law, our responsibility is limited to re-supplying the service or covering the cost of doing so.

6. Privacy

6.1 We handle personal information in accordance with our Privacy Policy, a full copy of which is available here, and in accordance with the Privacy Act 1988 (Cth).

7. Electronic communications

7.1 When you register, you may be added to AgentLink's contact list to receive updates, reminders, or offers related to our services. We may contact you via email, SMS, or phone to provide relevant property information or service updates.

7.2 Marketing communications will come only from AgentLink, unless you have expressly agreed to receive marketing from a third party (for example, a featured agent you have engaged).

7.3 If you prefer not to receive marketing messages, you can unsubscribe at any time by emailing info@agentlink.au.

8. Third-party links

8.1 Our website may include links to third-party websites for convenience or reference. We have no control over their content or practices and accept no responsibility for their accuracy, reliability, or security. Visiting these links is at your own discretion.

9. Changes to these Terms

9.1 We may update these Terms from time to time. Continued use of the website after changes are made means you accept the revised Terms.

9.2 It is your responsibility to check for updates. Changes take effect when published. If an update significantly impacts your rights or obligations — including material updates relating to data-privacy or platform-compliance obligations — we will notify you via a website notice, email, or another suitable method before the change takes effect.

10. General

10.1 Your use of this website is governed by the laws of New South Wales, Australia. Any disputes will be handled exclusively by the courts in New South Wales.

10.2 If any provision is invalid or unenforceable, it will be replaced with one that best reflects the original intent. The rest of the Terms remain effective.

10.3 AgentLink reserves the right to modify or discontinue parts of the website or services without notice. We are not liable for any resulting loss or inconvenience.

PART B — TERMS FOR HOMEOWNERS AND ENQUIRERS

11. Providing your information

11.1 You may share your details with AgentLink to access our services. Registration for homeowners is free and authorises us to use your personal information as described in these Terms and our Privacy Policy.

11.2 By providing your details, you acknowledge that:

• the information you submit, including contact and property details, is accurate and complete;
• you have read and accepted these Terms and our Privacy Policy;
• you were given access to these Terms before submitting your information and are providing informed consent; and
• you give permission for AgentLink to share your data with agents in accordance with clause 12.

12. How we share your enquiry

12.1 When you submit an enquiry through a Meta Lead Ad, website form, or similar online enquiry, your details will be shared with agents in your area so that they can respond to the enquiry or service you requested.

12.2 Your enquiry will be shared with either:

• (a) up to three (3) local Registered agents; or
• (b) a single Featured or Featured+ agent in your area, on an exclusive basis.

Your enquiry will not be shared with a combination of both categories.

12.3 Your information is shared with agents solely so they can respond to your enquiry, and is handled in accordance with our Privacy Policy.

13. Contact consent

13.1 By entering your phone number, you agree to receive calls and electronic messages from AgentLink and its affiliated partners, including the agent(s) to whom your enquiry is provided. This includes direct contact on Saturdays, Sundays, and public holidays.

13.2 You can unsubscribe from AgentLink marketing communications at any time by emailing info@agentlink.au.

PART C — TERMS FOR AGENTS

By creating an AgentLink agent account, and each time you accept a lead, you agree to these Terms (and, if you subscribe, to the additional subscription terms in clause 19).

14. Agent categories

14.1 These Terms apply to the following agent categories:

• Featured Agent — an agent who holds a current Featured subscription with AgentLink.
• Featured+ Agent — an agent who holds a current Featured+ subscription with AgentLink.
• Registered Agent — an agent who holds an AgentLink account but does not hold a Featured or Featured+ subscription.

14.2 In Part C, "Agent", "you", and "your" refer to any of the above categories unless a clause states that it applies only to a specific category.

15. Agent accounts and acceptance of these Terms

15.1 To receive or accept leads from AgentLink, you must create an AgentLink agent account. Creating an account requires you to accept these Terms.

15.2 You cannot accept a lead without an AgentLink account. Each time you accept a lead, you again accept these Terms as they apply at that time, including the referral fee obligations in clause 23.

15.3 By accepting a lead, you confirm that you understand and agree to the referral fee, notification, and lead-data obligations set out in this Part C in respect of that lead.

16. Agent information and verification

16.1 You acknowledge that AgentLink will collect, store, and process your personal and professional information, including but not limited to your name, contact details, sales statistics, and performance metrics.

16.2 Your data may be used for verification purposes, market research, and the creation of insights, analyses, and reports regarding agent sales performance and metrics. You consent to the collection, use, and disclosure of your personal information, including information sourced from third-party APIs, as part of AgentLink's services to our customers.

16.3 AgentLink and its data providers do not make any representation or warranty regarding the accuracy, currency, completeness, suitability, or reliability of API data or any other information accessible via any API product used in collecting data.

17. Public display of agent information

17.1 You consent to the display of your profile, including your name, contact details, sales history, and performance metrics, on the AgentLink website and in marketing materials.

17.2 Your information may be shared with homeowners and third parties associated with AgentLink.

18. Accuracy of agent information

18.1 You warrant that all information you provide to AgentLink is accurate, complete, and up to date, and you agree to notify AgentLink of any material changes.

18.2 Providing false or misleading information may result in removal from the platform.

19. Subscriptions and billing — Featured and Featured+ agents only

19.1 By becoming a Featured or Featured+ agent, you agree to pay the applicable subscription fee set by AgentLink. Subscription fees are payable in advance and are non-refundable.

19.2 All Featured and Featured+ subscriptions are billed monthly in advance through Stripe or another approved payment processor. By subscribing, you authorise AgentLink to automatically debit your nominated payment method each month for the duration of your subscription.

19.3 Subscriptions automatically renew unless written notice of non-renewal is received at least seven (7) days before the current term ends.

19.4 Refunds are not provided for partial months or early cancellations.

19.5 AgentLink reserves the right to vary subscription prices, but any change will only take effect at the end of the then-current subscription term.

19.6 AgentLink may suspend or terminate access if a payment fails or a chargeback occurs, without releasing the agent from their subscription commitment.

19.7 Holding a Featured or Featured+ subscription does not waive or reduce the referral fee in clause 23. Featured and Featured+ agents pay the referral fee in addition to their subscription.

20. Leads and lead distribution to agents

20.1 AgentLink distributes leads in accordance with clause 12. A Featured or Featured+ agent who receives a lead receives it on an exclusive basis for their area. A lead distributed to Registered agents may be shared with up to three (3) Registered agents. A single lead is never distributed to a mix of subscribed and Registered agents.

20.2 A lead can only be accepted through your AgentLink account and only on acceptance of these Terms (clause 15).

21. Fee review — Registered agents only

21.1 A Registered agent may request a review of the referral fee applicable to a lead ("Fee Review") within thirty (30) minutes of accepting that lead — for example, where the agent believes an exemption under clause 23 applies (such as a pre-existing relationship or a prior appraisal of the property).

21.2 The Fee Review option is available to Registered agents only. It is not available to Featured or Featured+ agents.

21.3 If no Fee Review is requested within the thirty (30) minute window, the referral fee applicable to that lead applies as notified and is payable in accordance with clause 23.

22. Handling of Lead Data

22.1 AgentLink may provide agents with homeowner contact information ("Lead Data") collected through AgentLink's website, Meta Lead Ads, or other marketing channels, solely for the purpose of contacting that homeowner regarding the property enquiry or service they requested.

22.2 Agents must use Lead Data only for this stated purpose and must not:

• sell, lease, share, or otherwise distribute Lead Data to any other party;
• add Lead Data to any external marketing, remarketing, or advertising audience (including Meta Custom or Lookalike Audiences); or
• combine or enrich Lead Data with any other dataset or CRM outside the purpose of the initial enquiry.

22.3 Agents must comply with all applicable privacy and data-protection laws, including the Privacy Act 1988 (Cth), and with Meta's Lead Ads Terms.

22.4 Agents acknowledge that Lead Data is owned by AgentLink until it is lawfully transferred for the limited purpose above.

22.5 If AgentLink determines that an agent has misused Lead Data, AgentLink may suspend or terminate the agent's account or subscription immediately, without refund.

23. Referral fee and commission discount

Referral fee

23.1 A referral fee applies to any lead provided by AgentLink that results in a successful sale. The referral fee is payable by the successful selling agent who received that lead from AgentLink. This applies to Featured, Featured+, and Registered agents.

23.2 The referral fee is twenty percent (20%) inclusive of GST, calculated on the agent's total sales commission inclusive of GST.

23.3 The "total sales commission inclusive of GST" means the total amount payable by the vendor to the agent for the sale, including any GST charged on that commission. The referral fee is calculated on this GST-inclusive total, and is not calculated on the GST-exclusive amount.

23.4 Worked examples:

• If an agent's total commission on a sale is $10,000 including GST, the referral fee payable to AgentLink is $2,000 (being 20% of $10,000).
• If a property sells for $1,000,000 and the agent charges commission at 2% + GST, the commission is $22,000 including GST ($20,000 + $2,000 GST), and the referral fee is $4,400 (being 20% of $22,000, comprising a $4,000 fee + $400 GST).

For clarity, the referral fee is not calculated on the commission after GST is removed. On a $10,000 GST-inclusive commission, the fee is $2,000 — not 20% of the GST-exclusive figure ($9,090.90).

Exemptions and conditions

23.5 No referral fee applies where the agent provides sufficient evidence that they had a previous relationship which resulted in an appraisal of the property within the six-month period directly before receiving the lead.

23.6 A referral fee is only payable if the property is listed within eighteen (18) months of the lead being sent to the agent. After eighteen (18) months, no referral fee applies.

23.7 If a different agent within the same office as the referred agent lists and sells the property, a referral fee will still apply, unless that agent can demonstrate that they appraised the property prior to the lead being sent by AgentLink. In that case, no referral fee is charged.

Commission discount

23.8 AgentLink may offer a commission discount to new clients. Any such discount is deducted from AgentLink's referral fee and does not impact the agent's commission earnings. By accepting these Terms, agents agree to honour any such discount extended to the client by AgentLink, as this forms part of the referral agreement.

Interest on unpaid referral fees

23.9 Failure to notify AgentLink of a pending referral fee will result in interest penalties being applied. Interest accrues at 10% per annum, calculated daily on the total referral fee outstanding.

24. Agent responsibilities and notifications

24.1 Agents must notify AgentLink when they sign an agency agreement with a referred client, and provide a copy of the signed agency agreement.

24.2 Agents must notify AgentLink when a referred property sells, including the final sale price and the commission charged, and provide a copy of the front page of the signed contract of sale as verification.

24.3 Agents must handle all Lead Data in accordance with clause 22, and confirm that they will not upload or use such data for advertising, audience creation, or unrelated marketing.

25. Performance and quality standards

25.1 AgentLink reserves the right to assess and verify your sales performance, client feedback, and industry reputation.

25.2 If you no longer meet the criteria for a Featured or Featured+ agent, your listing may be reviewed or revoked at AgentLink's discretion.

26. Termination

26.1 Either party may terminate the agreement with written notice, subject to any outstanding obligations.

26.2 If an agent terminates their account or subscription, they remain liable for any referral fees on sales from AgentLink referrals that occurred before termination.

26.3 A Featured or Featured+ agent remains liable for the subscription period they initially signed up for, and no refunds for the remainder of that period will be given on termination.

26.4 AgentLink reserves the right to terminate an agent's participation for failure to comply with these Terms, non-payment, low performance, or misconduct.

27. Agent liability and disputes

27.1 AgentLink is not liable for any disputes, misrepresentations, or issues arising between agents and homeowners. Agents assume full responsibility for all dealings with homeowners and other users of the platform.

By submitting your application, creating an account, accepting a lead, or through continued use of our site, you confirm that you have read, understood, and agreed to the parts of these Terms and Conditions that apply to you.
